The Supreme Court´s recent decision in Federal Maritime Commission v. South Carolina State Ports Authority, took another step towards diminishing the federal government´s power over the states -- ruling 5 to 4 that federal agencies may not hear complaints by private parties against states. What are the chances are that this trend will continue and lead to a further assault on the bankruptcy courts´ powers?
