Government contracts law and bankruptcy law are each creatures of complex and heavily regulated regimes. The financial viability of many government contractors may rest on one or more awards that might be derailed by a dispute over one contract. Such contracts may be different from the ordinary executory contracts familiar to many bankruptcy practitioners.


The interplay between bankruptcy and government contracts has been increasing in frequency, with some of the largest recent cases having been filed by government contractors in such critical sectors as energy, technology and manufacturing. These cases can even involve assets that have implications for our national security, creating even more complexity when attempting asset sales under the Bankruptcy Code.


This ABI Workshop, which features a faculty of experts from both fields, will equip government contracts practitioners and bankruptcy professionals with the tools to understand the issues that can arise in these cases so that they can best represent clients that find themselves caught in the unique confluence of insolvency and contracts law.
