Employee Benefits and Business Reorganization Committees Jointly Sponsor Panel at Winter Leadership Conference on "Retiree Health Benefits and 1114 Issues in Large and Middle Market Cases."
At the Winter Leadership Conference December 6-8, 2007 in Rancho Mirage, CA, the Employee Benefits in Bankruptcy Committee and the Business Reorganization Committee jointly presented a panel on "Retiree Health Benefits and 1114 Issues in Large and Middle Market Cases."
Speakers from Lazard Freres, the United Steelworkers Union, a major actuarial firm and two law firms spoke on the impact that retiree health and other legacy non-pension benefits have on reorganization, with particular focus on the use of VEBAs to pay future non-pension retiree benefits. The panel concluded that, in the right case, VEBAs can be just what the parties need to bridge their differences and reach an agreement. The program was well received by those in attendance.
